- Govt exempt EAC Nuts , Oil Crops Levies
Import levies on nuts and oil crops from East African Community (EAC) states are now exempted for businesses in Export Processing Zones (EPZ) and Special Economic Zones (SEZ), the Agriculture and Food Authority (AFA) said.
The exemption, effective immediately, follows a legal amendment aligning with the Finance Act 2023.
“In reference to Section 32(2) of the Crops Act, 2013, this exemption will take effect from 17th April 2025,” AFA said.
The Crops (Nuts and Oil Crops) Regulations 2020, provides for levies on imports and exports of nuts and oil crops produce and products as indicated in the Regulations.
“Agriculture and Food Authority is responsible for regulating, developing, and promoting the nuts and oil crops sub-sector as per the Crops Act 2013, AFA Act 2013,” read part of the statement.
On 14th February 2025,AFA said the Cabinet Secretary for Agriculture and Livestock Development,Mutahi Kagwe,through Legal Notice No. 26, amended the Crops (Nuts and Oil Crops) Regulations 2020 to align with Sections 101 and 102 of the Finance Act 2023.
AFA noted the East African Communities partner states which included: Democratic Republic of the Congo, Republic of Burundi, Republic of Rwanda, Federal Republic of Somalia, Republic of South Sudan, Republic of Uganda, and United Republic of Tanzania.
“The Authority will provide guidance on implementation of this change on the KenTrade TFP portal before the effective date.We urge all stakeholders to take note of these changes,” AFA noted.
Agriculture and Food Authority (AFA) is a state corporation under section 3 of the Agriculture and Food Authority Act of 2013.
The Act consolidates the laws on the regulation and promotion of agriculture and makes provision for the respective roles of the national and county governments in agriculture and related matters, in line with the provisions of the Fourth Schedule of the Constitution of Kenya.
